These terms and conditions (the "Terms") govern your use of the WalkFi app (the "App"), our website located at www.walkfi.com (the "Website"), and any related services provided by WalkFi (collectively, "WalkFi" or "we" or "us"). By downloading, installing, using, or accessing WalkFi, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree with these Terms or our Privacy Policy, please do not use WalkFi. Who can use WalkFi? WalkFi is intended for users who are at least 15 years old and have a compatible mobile device that can connect to the internet and track their steps. You must also create an account with WalkFi (an "Account") and provide us with some personal information, such as your name, email address, and date of birth. You must ensure that the information you provide is accurate and up-to-date. You are responsible for maintaining the security and confidentiality of your Account and password, and for any activity that occurs under your Account. You must not share your Account or password with anyone else, or use someone else's Account or password. You must notify us immediately if you suspect any unauthorized access or use of your Account. How does WalkFi work? WalkFi connects to the pedometer of your mobile device and tracks your steps. You can earn points for every step you take, and redeem them for various rewards, such as cash, gift cards, coupons, or donations to charity or social causes. The number of points you can earn and redeem may vary depending on various factors, such as your location, the type of reward, the availability of rewards, and our discretion. We reserve the right to change, modify, suspend, or terminate any aspect of WalkFi, including the points system, the rewards, and the eligibility criteria, at any time without prior notice or liability to you. What are the rules of using WalkFi? You agree to use WalkFi in a lawful, respectful, and responsible manner. You must not: - Use WalkFi for any illegal, fraudulent, or harmful purpose, or in any way that violates the rights of others; - Use any automated means, such as bots, scripts, or hacks, to manipulate, interfere, or tamper with WalkFi, the points system, or the rewards; - Use any false, misleading, or inaccurate information, or impersonate any person or entity, in connection with WalkFi; - Attempt to access, modify, or reverse engineer any part of WalkFi that is not intended for your use; - Transmit or upload any virus, malware, or other harmful code or content to WalkFi; - Harass, abuse, threaten, or defame any person or entity through WalkFi; - Violate any applicable law, regulation, or policy in your use of WalkFi. We reserve the right to monitor, review, investigate, and take appropriate action against any violation of these rules, including but not limited to, suspending or terminating your Account, removing or modifying your points or rewards, reporting you to law enforcement, or taking legal action. What are the limitations and disclaimers of WalkFi? WalkFi is provided "as is" and "as available", without any warranties, express or implied, of any kind. We do not guarantee that WalkFi will be uninterrupted, error-free, secure, or accurate. We do not endorse, warrant, or assume any responsibility for any rewards, products, services, or content offered or provided by third parties through WalkFi. You use WalkFi at your own risk and discretion, and you are solely responsible for any damages or losses that may result from your use of WalkFi. To the maximum extent permitted by law, we and our affiliates, partners, licensors, and service providers, and our and their respective officers, directors, employees, and agents, will not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use WalkFi, or any rewards, products, services, or content obtained through WalkFi, whether based on contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above exclusions or limitations may not apply to you. If you have any questions, comments, or feedback about WalkFi, you can contact us at support@walkfi.com. We will do our best to respond to you as soon as possible. How can I terminate my Account? You can terminate your Account at any time by deleting the App from your mobile device and contacting us at support@walkfi.com. Please note that if you terminate your Account, you will lose any points or rewards that you have not redeemed, and you will not be able to access WalkFi or any of its features. We may also terminate your Account at any time, for any reason, with or without notice, and without any liability to you. If we terminate your Account, these Terms will still apply to any disputes or claims that arose before or after the termination. How can WalkFi change these Terms? We may change, modify, or update these Terms at any time, for any reason, by posting the revised version on our Website or App, or by notifying you directly, at our sole discretion. Your continued use of WalkFi after any changes are made to these Terms will constitute your acceptance of such changes. If you do not agree with the changes, you must stop using WalkFi and terminate your Account. It is your responsibility to review these Terms periodically and stay informed of any changes.
